1. Acceptance of Terms
By accessing and using the services of Ben Cleaning Solutions ("we," "our," or "us"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services.
These terms apply to all users of our services, including clients, website visitors, and anyone who interacts with our business.
2. Services Provided
Ben Cleaning Solutions provides professional cleaning services including but not limited to:
- Commercial cleaning services
- After-construction cleaning
- Restaurant and kitchen cleaning
- Regular cleaning services (weekly, fortnightly, monthly)
- Residential cleaning services
- Specialized cleaning services as agreed upon
All services are provided subject to availability and our standard operating procedures. We reserve the right to refuse service at our discretion.
3. Service Agreements
3.1 Quotations and Estimates
All quotations and estimates provided are valid for 30 days unless otherwise stated. Final pricing may vary based on the actual scope of work required.
3.2 Service Schedules
Service schedules are agreed upon at the time of booking. We will make reasonable efforts to maintain scheduled appointments, but we are not liable for delays due to circumstances beyond our control.
3.3 Access to Premises
Clients are responsible for providing safe and accessible entry to the premises. We are not responsible for delays or inability to provide services due to lack of access or unsafe conditions.
4. Pricing and Payment
4.1 Pricing
All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated. Prices may be subject to change, and we will provide notice of any price changes for ongoing services.
4.2 Payment Terms
Payment terms are as follows:
- Payment is due within 7 days of invoice date unless otherwise agreed
- For ongoing services, invoices are issued weekly, fortnightly, or monthly as per the service agreement
- Late payment may result in suspension of services
- We reserve the right to charge interest on overdue accounts
4.3 Payment Methods
We accept payment via bank transfer, credit card, or other agreed payment methods. All payments must be made in Australian Dollars.
5. Cancellation and Rescheduling
5.1 Client Cancellations
Clients may cancel or reschedule services with at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee.
5.2 Our Cancellations
We reserve the right to cancel or reschedule services due to:
- Unsafe working conditions
- Inability to access the premises
- Extreme weather conditions
- Emergency situations
- Non-payment of invoices
We will provide reasonable notice when possible and will reschedule services at the earliest convenience.
6. Client Responsibilities
Clients are responsible for:
- Providing safe and accessible premises
- Securing or removing valuable or fragile items before cleaning
- Informing us of any special requirements or areas of concern
- Ensuring adequate lighting and access to all areas to be cleaned
- Providing necessary keys, access codes, or security arrangements
- Notifying us of any changes to the premises or cleaning requirements
7. Our Responsibilities
We commit to:
- Providing professional and thorough cleaning services
- Using appropriate cleaning products and equipment
- Ensuring our staff are trained and professional
- Maintaining appropriate insurance coverage
- Respecting your property and privacy
- Addressing any concerns or complaints promptly
8. Liability and Insurance
8.1 Limitation of Liability
To the maximum extent permitted by law, our liability for any loss or damage is limited to the value of the service provided. We are not liable for:
- Consequential or indirect losses
- Loss of profits or business opportunities
- Damage to items not disclosed or not accessible during cleaning
- Damage resulting from pre-existing conditions
8.2 Insurance
We maintain public liability insurance. Clients are encouraged to maintain their own insurance for valuable items and property.
9. Guarantees and Warranties
We guarantee our workmanship and will return to address any issues reported within 24 hours of service completion, provided the issue is due to our work and not due to:
- Pre-existing conditions
- Client interference with cleaned areas
- Circumstances beyond our control
- Failure to follow our recommendations
10. Confidentiality
We respect the confidentiality of our clients and their premises. Our staff are bound by confidentiality agreements, and we will not disclose any information about your business or premises to third parties without your consent, except as required by law.
11. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of Ben Cleaning Solutions and is protected by Australian and international copyright laws. You may not reproduce, distribute, or use our content without our written permission.
12. Dispute Resolution
In the event of a dispute, we encourage direct communication to resolve the issue. If a dispute cannot be resolved:
- We will attempt to resolve the matter through good faith negotiation
- If necessary, disputes may be referred to mediation
- These terms are governed by the laws of New South Wales, Australia
- Any legal proceedings will be conducted in the courts of New South Wales
13. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms.
14. Severability
If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
